Most of us aren't happy with JEE-2010 and the way it was conducted?Can we do something?Can we have a re-exam?

New Delhi: The Supreme Court on Tuesday rejected a petition seeking to restrain the government from declaring the result of the IIT Joint Entrance Examination 2010 on Wednesday.

The court dismissed the public interest litigation (PIL), calling it a stunt and a publicity venture.

The vacation bench of the Supreme Court headed by Justice G.S. Singhvi and comprising Justice C.K. Prasad said: 'The petitioner had neither the locus (standi) nor is there any justification for allowing him to intermeddle in the matter.'

Petitioner Chetan Upadhyaya, who claims to be a journalist, is secretary of Satya Foundation. He sought to restrain the human resource development ministry from declaring the result Wednesday.

Justice Singhvi said that 'no court can play with the career of young students who are aspiring to join engineering and other courses in IITs'.

The court repeated that the petitioner had 'no locus (standi) or prima facie case for the grant of stay of the declaration of the result'.

The court wondered if the petitioner realised the kind and magnitude of harm the students would suffer if the result was stayed.

Justice Singhvi asked: 'What will happen if (as a consequence) some students commit suicide?'

The court said normally it would have dismissed the petition with exemplary cost running into five figures. But since the petitioner was a young man and apparently misguided, he was being let off lightly.

However, the court said that if the petitioner was again found indulging in such publicity centric petitions, he would attract huge costs.

The court also told counsel for the petitioner to be more 'circumspect and discreet' in filing such petitions in the disposal of which substantial time of the court is spent.

The bench said that it was accountable to the people and every second the Supreme Court spends involves costs.

The petition said the instruction manual issued to examinees along with the question paper differed for the students who took the exam in English medium and those who took the exam in Hindi medium.

Section 4 of Paper II of JEE had 48 marks for those who appeared in English and just 18 for those who took it in Hindi. Thus the difference in the aggregate marks of both the medium was 30 marks.

NEW DELHI: The Supreme Court on Tuesday refused to entertain a PIL seeking stay on tomorrow's declaration of results of the prestigious IIT Joint Entrance Examination for 2010-11 and the slammed the petitioner NGO Satya Foundation for its "publicity stunt."

Questioning the locus standi and the intention of the petitioner, the apex court queried, "Did you ever bother to take up the cause of those killed in Dantewada (75 CRPF personnel) or those who lost their lives in the recent natural calamities."

The PIL had sought stay of the results on the ground that there were several errors in the instructions attached to the question paper and faulty marking system which it claimed undermined the prospects of over 3000 students.

A vacation bench of Justices G S Singhvi and C K Prasad, while dismissing the PIL, cautioned that any such stay would affect the career of over four lakh students and might lead to serious consequences including suicides by the aspirants.

The bench rebuked Chetan Upadhyaya, secretary of the association and said it would have imposed a huge cost on the petitioner but was refraining from doing so as he was a young man and appeared to have been misguided.

"Some students will even commit suicide. Who will be responsible for it if we stay the results. There are three types of PILs--Public Interest Litigation, Private Interest Litigation and Publicity Interest Litigation. This petition has been filed as a publicity stunt," the bench observed.

The apex court said it was convinced that the petitioner has no locus standi and justification to meddle with the declaration of the results.

"Ordinarily we would have saddled the petitioner with a five figure amount. But keeping in view the fact that he is young and seems to have been misguided, we refrain from doing so," the bench observed while dismissing the appeal.

Senior counsel R Venkatramani appeared for the Union Government.

The Delhi High Court had earlier on May 19 dismissed the NGO's plea for staying the result but kept the petition pending with a direction to the IIT's organising committee for JEE to demonstrate before it on June 2 the software adopted for evaluation of answer sheets.

The high court had also sought an affidavit from the committee about the corrective measures taken by it to protect the IIT-JEE aspirants from any disadvantage.

Even as the high court was seized of the matter, the NGO sought to approach the apex court for stay of the results scheduled for tomorrow which evoked the bench's ire and rebuff.

Patna: All 30 students of Super 30, the free coaching institute set up for poor students in Patna, have cracked the entrance test for the prestigious Indian Institutes of Technology (IIT).

“All the 30 students have cleared IIT-JEE," said Anand Kumar, the institute's director-founder, at a press conference on Wednesday.

Kumar said institute’s students are from poor families and studied for 16 hours a day. "We will try to arrange loans for the education of the poor students who qualified for IITs," he said.

The coaching institute will try to arrange full scholarships including for its students, said Kumar, who claims he missed a chance to study at Cambridge University because he didn’t have money.

Shubham Kumar Gautam, one of the institute’s students, said his father is a poor farmer in Nalanda and earned income less than Rs 2,500 per month. Gautam said he would not have been able to qualify for IIT had Super 30 not helped him.

How come all 30 have cleared ???

If I'm not wrong Anand Kumar was 1 of the persons who fought for re exam in

support of his Hindi Medium students

He must have checked the key after his students have written

If they were sure to be qualified then why was he asking for re-exam ??

So, ................. Any gambling in results ???

now just leave all this talk as nothng culd be done anymore......if nyone wants to clear IIT if have not then try for next year

even i supported re-exam but now nothng culd be done :'(

But i was just wondering if the compensating marks given for Hindi students m8 be a reason for the high cut offs

Yaa ... Nishant sir's absolutely right about what he said of vested intersts. I am one such culprit .... joined this site after JEE exam ..... perhaps could have done much better if I had joined earlier!!! This site gives lots of scope for problem practice and learning ... a good site indeed!!!
